Terms and Conditions

  1. REGISTRATION: Real Estate: Bids will only be accepted from registered bidders. You will be required to show your Driver’s License and your Cashier’s Check which needs to be 10% of the high bid price, to register to bid. Inventory:  Bids accepted only from registered bidders only.  Please bring your driver’s license for identification.  Registration will begin the day before the Auction at the scheduled Preview and also the morning of the Auction at 8:15 a.m.   Receipt of a bid number, implies an understanding of legal obligation to all Terms and Conditions. 
  2. DEPOSIT|PAYMENT TERMS: Real Estate:  The successful bidder will be required to sign a Memorandum of Sale,immediately following the falling of the hammer, and the Cashier’s Check, in the amount of 10% of the Sales Contract Price, will be delivered to the Substitute Trustee. The Deposit will be applied to the Contract Sale Price at closing.  The Deposit is Non-Refundable, unless the Trustee cannot convey title. Closing to take place within 30 days of sale.  Time is of the Essence.  Inventory:  All items purchased MUST BE PAID IN FULL on Sale Day by Cash, Cashier’s Check, Credit Card or Personal Check.  Anyone who has purchased item(s) at the Auction, is not allowed to leave the lot without paying for items. We will  accept credit cards and there will be an additional 3% fee that applies for using credit cards. 
  3. DEED: Real Estate:  The property will be conveyed by Special Warranty Deed.
  4. ANNOUNCEMENTS: Announcements made on the day of sale take precedence over  all prior  communications, both verbal and written, concerning the sale or the property or the Inventory.
  5. BUYER’S PREMIUM:  Real Estate:  There will be a 5% Buyer’s Premium in effect on day of sale. The Buyer’s Premium will be added to the successful bid amount, to determine the Contract Sale Price.  Inventory:  There will be a 10% Buyer’s Premium added to the high bid to determine the final Purchase Price.
  6. “AS-IS”, “WHERE-IS”: Real Estate:  The  property is being sold “AS-IS”, “WHERE-IS”.  Potential Buyers must  perform such independent investigations with respect to the property as they deem necessary to verify information provided by Auction Company or the Seller. Inventory:  All Inventory, Equipment and Tools are being sold  “AS-IS”,  “WHERE-IS”,  with no warranties.   Potential purchasers must perform such independent investigations, with respect to the inventory as they deem necessary.  ALL SALES ARE FINAL! No refunds made to the purchasers – for ANY reason.
  7. ADVERTISEMENTS: All information provided by Auction Company and the Seller is deemed reliable but is not warranted. The information contained in this brochure and any advertisements by Auction Company are subject to verification by all parties relying on it.  No liability for its accuracy, error or omission is assumed by the Auction Company or the Seller.
  8. REPRESENTATION: Auction Company and its representatives represent the Foreclosing Party.
  9. BID INCREMENTS: Auction  Company  reserves the right to set  bid  increments and to establish  the bid sequences for the order of the Sale and/or  to change both.
  10. DISPUTES: The Auction Company reserves the right to settle any and all disputes involving bids or sale of Inventory.  The bidder agrees to pay all Attorney’s Fees and Court Costs for any disputes which require enforcement through the Court System.
  11. REMOVAL: All equipment must be removed by September 18th at 4:00 p.m., If any arrangements need to be made, you must call Anthony Smithers at (540) 420-3501 to schedule an appointment to remove.
  12. ALL SALES ARE FINAL!
